Florida's proposed constitutional amendment to guarantee abortion access failed, even though more than half the voters approved it. Why?

Arizona: Proposition 139, for which the AP projected a win at 3:31 a.m. EST with 62.3% support, would create a “fundamental right to abortion” in the state Constitution, which prohibits the state from banning abortion before a fetus is viable and would overturn the state’s 15-week ban.

South Dakotans voted to support the amendment while 61% voted in opposition, according to the Secretary of State's website.

Florida’s voters were asked whether the state’s constitution should say that “no law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider.”

Missouri’s current law bans abortion with almost no exceptions and this amendment would allow abortion to about 24 weeks of pregnancy.

With voters declining to enshrine a right to abortion in the State Constitution, South Dakota will continue to have one of the strictest abortion bans in the country.

Amendment 4 failed in Florida after not meeting the 60% threshold to pass, according to the Associated Press. Florida voters decided to keep the current abortion law which restricts abortion to the first six weeks of pregnancy.
